Amaya Travel, LLC (hereinafter referred to as “Amaya Travel,” “we,” “us” and “our”) values your privacy. This Privacy Policy states the principles and practices that apply to our collection and use of information that you, our clients and prospective clients (hereinafter referred to as “you” and “your”) provide to us, whether in person, by telephone, mail or email, or through our website, https://www.amaya-travel.com/(the “Website”). This Privacy Policy governs our collection, use, and processing of personal information both through this Website and through the other means by which we interact with our clients and prospective clients, including in person, by telephone, email, text or other electronic communications, online forms, travel-planning and itinerary platforms, booking and reservation systems, and other client communications. This Privacy Policy does not apply to any other website, URL, or online service used or licensed by Amaya Travel that is operated by a third party.


Scope of This Privacy Policy

This Privacy Policy applies to Personal Information Amaya Travel collects, uses, discloses, stores, or otherwise processes in connection with our travel planning and related services, whether collected through our Website or provided to us through other means, including in person, by telephone, email, text or other electronic communications, online forms, travel-planning and itinerary platforms, booking and reservation systems, and other interactions with our clients and prospective clients.


Our services may involve third-party websites, applications, booking platforms, travel suppliers, payment processors, technology providers, and other service providers that maintain their own privacy policies and practices. This Privacy Policy does not govern the independent privacy practices of those third parties. We encourage you to review the privacy policies of third-party services and travel suppliers with which you interact.


By accessing or using our Website, engaging our services, or otherwise providing Personal Information to Amaya Travel, you acknowledge the collection, use, disclosure, and processing of Personal Information as described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use our Website or provide Personal Information to Amaya Travel. By using the Website, you explicitly accept, without limitation or qualification, our practices surrounding the collection, use, and sharing of personal information provided by you in the manner described in this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access, browse, or use the Website.


How We Collect and Use Personal Information

Some information is explicitly provided to us by you, while other information, such as your IP address, is gathered automatically as you use our services. You may voluntarily provide certain personal identifying information to us in connection with your use of our interactive web portals, your purchase of travel-related products, any signup incentives or promotions you elect to participate in, newsletter or other subscriptions, and services (all of which will be referred to as “Personal Information”). If you choose to provide us with Personal Information by opting in, you consent to our collection of that information and

to the transfer and storage of that information on our servers located in the United States. Personal Information includes all information you voluntarily provide to us, whether in person, by telephone, mail or e-mail, or on this Website, such as:


  • (1) your contact information (e.g. name, telephone number, passport number, driver’s license or state identification number, and postal and e-mail addresses);
  • (2) financial information (e.g. credit card number, security code, cardholder name, billing address, and expiration date);
  • (3) information related to your travel profile (e.g. booking history, travel preferences and interests, identity of any travel companions, airline and hotel and rent-a-car loyalty program information); and
  • (4) information related to disability, medical condition and special health accommodations.


We may use your Personal Information to provide you with travel-related information, including providing you with responses to requests for travel services, travel notifications, travel advisories or warnings, travel confirmations and updates, as well as managing your account, processing bills, and/or personalized mailings (electronic or otherwise) or other communications that you consent to receive, and to prevent potentially prohibited or illegal activity, resolve disputes and collect fees.


To Whom is Your Personal Information Disclosed

Amaya Travel may share your information with third parties to facilitate your travel plans or requests for information. We may share your Personal Information (only to the extent reasonably necessary or as required by the circumstances) and Aggregated Data, when applicable, with the following parties:


  • (1) Third-party vendors, web hosting service providers, travel service providers, host travel agencies and other reputable travel industry intermediaries in order for such parties to: (i) assist Amaya Travel in providing the requested travel services to you, (ii) assist Amaya Travel in personalizing your experience which includes informing you of future travel opportunities and offers (iii) provide aggregate reporting to Amaya Travel and certain third parties (using only Aggregated Data and not individual Personal Information when provided to third parties), and (iv) provide emergency client assistance if applicable and eligible.
  • (2) Third-party vendors, travel service providers, host travel agencies and other travel industry intermediaries which provide certain services or functions requested by you and/or which fulfill your requested transactions, including but not limited to, cruise lines, airlines, hotels, destination management companies, event sites, tour operators, travel insurance companies, ground transportation providers, and car rental companies, as well as service providers who assist with our business operations (such as fraud investigations, bill collection and affiliate and award programs).
  • (3) Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service).
  • (4) The appropriate parties if it is requested by a government agency or law enforcement personnel or if we are otherwise required by law to disclose it in response to subpoenas, court orders, or other legal process, to establish or exercise our legal rights, to defend against legal claims, or as otherwise required by law (in which case, we reserve the right to raise or waive any legal objection available to us).
  • (5) Other appropriate entities, such as our successors or assigns, should we undergo a corporate transaction, such as a divestiture, merger, consolidation, or asset sale.
  • (6) The appropriate parties when we believe in good faith that disclosure is required to investigate or prevent suspected illegal activity, to protect the security, property, assets and/or rights of Amaya Travel from unauthorized use or misuse of the Website or anything found at the Website. 


Once your Personal Information has been shared with a non-affiliated third party in accordance with this Privacy Policy, we cannot control how that third party collects, uses or shares your Personal Information and as such, we will thereafter have no responsibility for its use. Protection of your Personal Information in the possession of any such third party shall be governed by the Privacy Policy of that third party.


How We Retain Your Personal Information

We keep the categories of Personal Information described in this Privacy Policy for as long as reasonably necessary to fulfill the purposes for which it was collected, including to provide travel-related services to you, to manage your account and travel profile, and to operate our business, and for as long as otherwise permitted or required by applicable law, such as to comply with our legal, tax, accounting, and recordkeeping obligations, to resolve disputes, and for safety, security, and fraud-prevention purposes. Because retention needs vary by the type of information and the reason it was collected, we do not apply a single retention period to all Personal Information. In determining how long to retain Personal Information, we consider the nature and sensitivity of the information, the purposes for which we collected it, our legal and business obligations, and the potential risks of harm from unauthorized use or disclosure. When Personal Information is no longer needed for these purposes, we take reasonable steps to delete, destroy, de-identify, or otherwise render it unreadable.

Third-Party Services

Amaya Travel may provide third party links, or otherwise cooperate with third-party service providers, to provide you with access to travel transaction management resources such as an online booking engine or an electronic document execution program. These online resources are independently owned and operated by third party providers and are not under our control. Amaya Travel may provide access to these resources as a service to you, and is not responsible for their operation, content, information practices or any link contained in a linked site. These resources often gather personally identifiable information and financial information from you to complete your booking requests. And our service may include providing some of your Personal Information to the third party provider to help streamline the booking process.


Artificial Intelligence (AI) and Automated Processing

Amaya Travel may, from time to time, use artificial intelligence (“AI”), machine learning, and other technology-assisted tools to support certain business functions, including travel research, drafting or refining client emails and itinerary content, itinerary development, summarizing information, and other administrative workflows. These technologies may also be used for purposes including, without limitation: analyzing usage patterns to enhance the user experience; providing personalized content, recommendations, itineraries, or travel services; supporting customer service through AI-powered chatbots or virtual assistants; detecting, preventing, and investigating fraud, abuse, security incidents, and policy violations; flagging potentially harmful or inappropriate content; and supporting internal analytics, research, and service optimization.


In connection with these activities, limited Personal Information may be processed by third-party technology service providers. In some cases, the information being processed may include a client’s name, email address or phone number, mailing address, travel dates, destination, and itinerary or reservation details, when reasonably necessary to perform the applicable business function. Amaya Travel seeks to limit the Personal Information provided to AI-assisted tools to information reasonably necessary for the applicable purpose.   Amaya Travel does not intentionally provide sensitive information, such as passport details, government-issued identification numbers, credit card information, or dates of birth, to general-purpose AI tools, although such information may occasionally appear within an uploaded supplier document.  AI-assisted tools are used to support, rather than replace, Amaya Travel’s professional judgment and services. Amaya Travel maintains human oversight of client communications, recommendations, and travel planning services produced with the assistance of such technologies. Personal Information processed through third-party technology providers is also subject to the applicable provider’s privacy, security, and data-processing practices.


In connection with these activities, Amaya Travel may process information you provide to us, information collected automatically through your use of our services, and information obtained from third parties, as described in this Privacy Policy. Where permitted by applicable law, we may use such information to infer your preferences, interests, or likely travel needs and to create or refine profiles for personalization, recommendation, and service improvement purposes. We may also use anonymized or aggregated data to train, develop, or improve AI systems. We do not use Personal Information for AI model training unless we have obtained your consent or are otherwise authorized to do so under applicable data protection laws.


Amaya Travel may also engage third-party service providers to support AI and automated processing activities. These providers may process Personal Information on our behalf in accordance with contractual restrictions and applicable law and may also process data in accordance with their own privacy policies where applicable. In some cases, our AI technologies may act on your instructions to assist with or complete bookings, itinerary changes, or other travel-related transactions. Where you direct an AI-enabled feature to take such actions, it may select, reserve, modify, or confirm services based on your inputs, preferences, and other available information, either automatically or with limited human involvement. In some instances, transactions may require your review and confirmation before completion.


To the extent we use automated processing, including profiling, to make decisions that produce legal or similarly significant effects, we will provide any notices, disclosures, and rights required under applicable law. Where required, you may have the right to request human review or intervention, express your point of view, and contest such decisions. Where required by applicable law, we will obtain your consent before using Personal Information for certain AI-related purposes and will provide any additional disclosures or opt-out rights required by law. Third-Party Privacy Policies

Vendors, suppliers of travel services, host travel agencies, other travel intermediaries, and other third parties with whom we share your Personal Information may have their own privacy policies accessible which may be on their own websites. We strongly encourage you to review those privacy notices. Amaya Travel’s Privacy Policy does not apply to these vendors, suppliers of travel services, host travel agencies and other travel intermediaries, and other third parties, as their policies may differ from our Privacy Policy.

When you visit or access the Website, our systems or our web hosting service provider may send one or more cookies (small text files containing a string of characters) to your computer that uniquely identifies your browser. Cookies alone do not tell us your e-mail address or other Personal Information unless you choose to provide this information to us by, for example, using certain interactive features on our Website. We use cookies to improve the quality of the Website by storing user preferences and tracking user trends. Amaya Travel does not sell travel or other services for purchase by children. This is a general audience website and does not offer services directed to children. Should a child whom we know to be under 18 send Personal Information to us, we will use that information only to respond directly to that child to inform him or her that we must have parental consent before receiving his or her personal information.


California Residents—Your California Privacy Rights

California law gives California residents certain rights with respect to their Personal Information. Under California’s “Shine the Light” law (California Civil Code § 1798.83), a California resident who has an established business relationship with us may request, once per calendar year and free of charge, information about the categories of Personal Information (if any) that we disclosed to third parties for those third parties’ own direct marketing purposes during the prior calendar year, together with the names and addresses of those third parties. As stated in this Privacy Policy, we do not share Personal Information with third parties for those third parties’ own direct marketing purposes without your consent.

We do not sell your Personal Information, and we do not share it for cross-context behavioral advertising.
